Should I have a short sale lawyer review the Contract?

As with virtually any area of life, you are not required to use an short sale attorney or real estate lawyer to complete a short sale. However, in many cases short sales can be as complicated and the documents are confusing as those when you purchased the property and guidance may be required. The terms of the Contract control your legal rights in the short sale and whether or not the team you work with gets the approval of the lender/bank and a waiver of the balance of the debt are the most critical events in a short sale and therefore caution should be exercised and in many cases legal counsel should be obtained. Purchase and Sale Contracts in short sales must be reviewed carefully much like Listing Agreements to ensure the parties no their financial obligations at closing and their rights should the lender/bank not approve the short sale. One important issue to address is the payment of closing costs.
